Divorce Certificate, Final Order or Divorce Decree?
Divorce records vary by country and legal system. A conditional stage may not prove that a marriage has ended. In England and Wales, applications issued on or after 6 April 2022 use the term final order; earlier cases used decree absolute. Send the actual final document rather than relying only on its title. For more on which record to submit, read our divorce certificate vs decree absolute guide.
Final Order / Decree Absolute
In England and Wales, the final document ending the marriage is a final order for proceedings issued on or after 6 April 2022, or a decree absolute in older cases. Official final-order guidance.
Conditional Order / Decree Nisi
An earlier stage of the process that does not by itself end the marriage. It is not interchangeable with a final order or decree absolute when final divorce evidence is required.
Foreign Divorce Certificate or Judgment
Overseas courts and registries may issue decrees, certificates, judgments or extracts. Their legal effect depends on the issuing country's law and the UK's recognition rules, not merely on the document name or its English translation.
Divorce Certificate Translation for Remarriage in the UK
For a proposed marriage in England or Wales, a register office will normally need evidence that a previous foreign divorce is final, together with an English translation when the divorce record is in another language. Overseas divorces may require separate checks and fees, and some cases are referred for further review. See a council example of the document requirements. If a foreign-language marriage record is also requested, see our marriage certificate translation service; confirm the exact documents required with the register office first.
Send the exact divorce record you intend to rely on
Do not assume a provisional decision, an extract without the final ruling or a certified translation alone satisfies the register office's requirements. Some overseas divorces require a recognition check before remarriage can proceed. Ask your register office which final document and supporting records to provide.
Foreign Divorce Certificate & Judgment Translation
“Divorce certificate” is not the only form a foreign divorce record can take. We translate the official text and document format; we do not decide whether an overseas divorce is recognised in UK law.
Recognition can depend on whether the divorce is legally effective in the country concerned and other conditions under the Family Law Act 1986, section 46. More complex non-court or cross-border divorces may need legal advice. We can translate the evidence, but the competent authority determines its legal status.
